However, psilocybin mushrooms have a long history of medical and spiritual use as we have written about and have played an important cultural role in many traditions around the world. Figures such as Maria Sabina helped shape modern understanding of ceremonial work with mushrooms. Compared to other psychoactive substances, their abuse potential is considered significantly lower, which is why discussions about their medical regulation keep resurfacing.

Legality of hallucinogenic mushrooms
Many countries maintain strict regulations on psilocybin mushrooms, although the legal situation is often ambiguous. In numerous jurisdictions the substances psilocybin and psilocin are explicitly prohibited, but the mushrooms themselves are not always mentioned directly in the legislation. This creates a grey area where possession of natural material may be treated differently depending on local interpretation, selective enforcement and the cultural context of the country.
As a result, regulations vary widely. Some countries focus primarily on synthetic substances, others criminalize all forms of possession, while some turn a blind eye to decriminalized personal use but keep cultivation illegal. This inconsistency makes international comparison difficult and often confusing for travellers and researchers.
Legal status of psilocybin spores
The legal situation regarding spores of hallucinogenic mushrooms (including popular varieties such as Golden Teacher or Mazatapec ) differs even more. Spores contain no psilocybin or psilocin and therefore are not classified as controlled substances in many jurisdictions, including Poland. This makes them legal to buy, own and study for mycological or educational purposes. In some countries, however, spores can still fall under broad regulations banning equipment or materials intended for drug production, even if they contain no active compounds.
Legality of hallucinogenic mushrooms in the United States
Regulations in the United States vary sharply from state to state. Some states — such as California, Georgia and Idaho — explicitly ban psilocybin mushroom spores. Cultivation is considered drug production in most regions and may carry severe penalties. However, a few jurisdictions interpret the law differently. In New Mexico, for example, courts have ruled that cultivation of natural psilocybin mushrooms does not constitute “production” of a controlled substance.
In recent years, several milestones have changed the national landscape. On November 3, 2020, Oregon became the first U.S. state to fully legalize supervised psilocybin-assisted therapy. Colorado followed in 2022, creating a regulated framework for the use of natural entheogens in therapeutic settings. In California, lawmakers have been debating a bill that would legalize the possession and sharing of limited amounts of psilocybin, psilocin, DMT, ibogaine, mescaline and MDMA for personal use. Although progress is uneven, the national trend clearly moves toward decriminalization and regulated therapeutic access.
Are psilocybin mushrooms legal in Poland?
We strongly advise against cultivating or possessing psilocybin mushrooms, as the substances they contain are illegal in Poland and in many other countries. By purchasing any mycological product, you declare that it will be used solely for legal, educational purposes and not for the production of psychoactive substances.
The content on the psychodelicroom.pl website is educational, research-based, and expresses many opinions that should be treated with caution. We advise against using any substances that affect consciousness, as all of these substances can both heal and be harmful. In particular, we advise against cultivating mushrooms from growkits in countries where it is illegal — including Poland — because it involves criminal liability. We recommend that you dispose of the growkits purchased from us within 72 hours of receiving them.
