Legal status of psilocybin spores

Many jurisdictions (states such as California, Georgia and Idaho) have explicitly banned the sale and possession of psilocybin mushroom spores. The cultivation of these mushrooms is considered drug production in most jurisdictions and is often severely punished (echoes of the Vietnam War still ring out), although some countries and one US state (New Mexico) have ruled that the cultivation of psilocybin mushrooms does not qualify as "production" of a controlled substance. On November 3, 2020. Voters have passed an Oregon ballot initiative making "magic mushrooms" fully legal for psychiatric treatment in supervised facilities starting February 1, 2021. A bill is currently pending in the California state legislature that would legalize "possession, obtaining, giving away, or transporting specified amounts of psilocybin, psilocin, dimethyltryptamine (DMT), ibogaine, mescaline, lysergic acid diethylamide (LSD), and 3,4-methylenedioxymethamphetamine (MDMA)." And in 2022, Colorado became the second state in the US to legalize hallucinogenic mushrooms.
