Legality of hallucinogenic mushrooms

There is a lot of ambiguity in many national as well as regional regulations on psychoactive substances as to the legal status of hallucinogenic mushrooms, as well as a constant element of selective enforcement, as unlicensed possession of psilocybin and psilocin is considered illegal, but the mushrooms themselves are not mentioned in these regulations.
Legal status of psilocybin spores
The legal status of hallucinogenic mushroom spores (such as Golden Teacher or Mazatapec, for example) is much more divergent, as the spores contain neither psilocybin nor psilocin, and therefore are not illegal to sell or possess in many jurisdictions (including Poland), although many jurisdictions will prosecute under broader laws prohibiting items used in drug production (this section of Poland no longer applies).
Legality of hallucinogenic mushrooms in the US
Many jurisdictions (states such as California, Georgia and Idaho) have explicitly banned the sale and possession of psilocybin mushroom spores. The cultivation of these mushrooms is considered drug production in most jurisdictions and is often severely punished (echoes of the Vietnam War still ring out), although some countries and one US state (New Mexico) have ruled that the cultivation of psilocybin mushrooms does not qualify as "production" of a controlled substance. On November 3, 2020. Voters have passed an Oregon ballot initiative making "magic mushrooms" fully legal for psychiatric treatment in supervised facilities starting February 1, 2021. A bill is currently pending in the California state legislature that would legalize "possession, obtaining, giving away, or transporting specified amounts of psilocybin, psilocin, dimethyltryptamine (DMT), ibogaine, mescaline, lysergic acid diethylamide (LSD), and 3,4-methylenedioxymethamphetamine (MDMA)." And in 2022, Colorado became the second state in the US to legalize hallucinogenic mushrooms.
